Events terms and conditions

Please read these terms and conditions carefully before booking any Courses or events from the Site. You should understand that by booking any of our Courses or events, you agree to the terms and conditions.

Please understand that if you refuse to accept these terms and conditions, you will not be able to book any Courses or events from the Site.

1 INFORMATION ABOUT US

1.1 The Courses are supplied by The Marine Biological Association of the United Kingdom (MBA, we, us, our). We are registered in England under company number RC000865 and with our registered office at The Laboratory, Citadel Hill, Plymouth, Devon, PL1 2PB. Registered Charity Number: 1155893

2 SAFEGUARDING

2.1 The MBA is committed to safeguarding and the protection of children and vulnerable adults who take part in MBA activities online or in person.  The MBA’s safeguarding policy is available on request.  Our nominated safeguarding lead is Maya Plass 07551153578 or maya.plass@mba.ac.uk and the nominated safeguarding deputy is Lance Gregory lgreg@mba.ac.uk.  In the case of a safeguarding concern please contact either of the above.

3 CONDUCT AND BEHAVIOUR

3.1 Anyone attending a course or event either online or in person is expected to conduct themselves is a safe and professional manner at all times. The MBA reserve the right to ask anyone behaving inappropriately to leave the premises or the virtual space. The MBA has the right to refuse any person admission or to ask any person to leave immediately. 

4 RIGHT TO STUDY 

4.1 You must have the right to study in the UK before attending any courses run by the Marine Biological Association. 

5 INSURANCE

5.1 The MBA has its own insurance cover in place in respect of its own legal liability.  There are limits and exclusions in the insurance cover MBA has been able to arrange and the Customer is responsible for making its own arrangements for the insurance of any excess loss. It is recommended that the Customer obtains insurance cover in respect of all risks which may be incurred by the Customer, arising out of the Event.

 

6 CANCELLATION OF COURSE BOOKING POLICY

6.1 You may cancel a Course booking at any time. To cancel a Course, you must do this through this portal.

6.2 If you cancel a Course or event more than 30 days before the start date of the event, you are eligible to receive a full refund minus a 5% admin fee.

6.3 If you cancel your course or events within 30 days of the start date you will not be eligible for a refund.

7 PRICE AND PAYMENT

7.1 You will be responsible for paying us the Course or event Fee unless you cancel your booking within the period of eligibility for a refund as set out above.

7.2 Please note members will receive generous discounts on courses with all prices listed with the course details, however non-members will not see member only prices when booking.

7.3 Course Fees are liable to change at any time, but changes will not affect bookings already made.

8 OUR REFUNDS POLICY

8.1 If you cancel a Course or event 30 days before the Course or event begins you will be eligible for a full refund of the Fee minus an admin fee equal to 5% of the course fee that you have paid.  If you cancel a course or event within 30 days of the beginning of the course or event you will not be eligable for a refund. 

8.2 We will usually refund any money we receive from you within 30 days of receiving your cancellation request providing it is in accordance with the provisions for refund eligibility described above. The refund will be made using the same method you originally used to make your booking.

9 OUR LIABILITY

9.1 Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to a refund of the Fee that you paid us.

9.2 Our liability shall not extend to loss of income, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, or any indirect or consequential loss, damage or expense.

9.3 This clause does not limit in any way our liability resulting from any fraud or misrepresentation, or for death or personal injury caused by our negligence.

10 EVENTS OUTSIDE OUR CONTROL

10.1 From time to time we may have to cancel courses or events due to extreme weather or other factors, in these cases we will firstly reschedule the event or course however if you are unable to make the new dates we will offer a full refund.

10.2 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

11 OUR RIGHT TO VARY THESE TERMS AND CONDITIONS

11.1 We have the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system's capabilities.

11.2 You will be subject to the policies and terms and conditions in force at the time that you book Courses with us.

12 LAW AND JURISDICTION

12.1 Contracts for the purchase of Courses through the Site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the courts of England.

 13 PRIVACY

13.1 The MBA is registered with the Information Commissioner’s Office (ICO) with the Data Protection Registration Reference Z8249388.

13.2 We occasionally work with sub-contractors to deliver training courses and event activities, we will only share your data with these sub-contractors where it is essential for the effective delivery of the event.
